Bill to Streamline CON Clears Committee

Legislation that would streamline the certificate of need review process cleared the House Health Services Committee today with a committee substitute. House Bill 407, sponsored by Representative Marianne Proctor of Union, would remove an unconstitutional barrier to certificate of need approvals and ensure the process is fair and clear for applicants and the public. This bill would also require the Cabinet for Health and Family Services (CHFS) to create a process for obtaining important information from affected parties. 

“In Kentucky, the certificate of need review process is often long and complicated, with applicants facing numerous obstacles before reaching a final decision,” said Proctor. “House Bill 407 simply seeks to make this process more efficient by reducing delays and delivering timely decisions to applicants.”  

The measure would also require CHFS to issue final decisions within 90 days and preserve the applicant’s right to appeal decisions to the Franklin Circuit Court. 

“Streamlining this process would allow us to focus on what matters most—ensuring Kentuckians have access to care within their community,” Proctor added. “I also want to thank House Health Services Chair Representative Kim Moser for calling this important piece of legislation.”
